Probate

pro·bate

Short Definition

The court-supervised legal process of administering a deceased person’s entire estate, including appointing someone to act, paying off outstanding debts, and distributing remaining assets to heirs or beneficiaries. Real property often has to pass through it.

In a Sale

What This Means When the House Is Being Sold

Probate is the reason a property sale that would otherwise take thirty or forty five days can stretch to several months or longer. Every step, appointment, notice, sometimes confirmation, has its own timeline set largely by the court rather than by the family or the market, and a buyer accustomed to an ordinary closing needs that explained clearly.

Not every property owned at death actually goes through probate. Assets held in a trust, in joint tenancy with right of survivorship, or with a properly executed transfer on death deed typically pass outside the process entirely. Determining which category a property falls into is the first question any estate sale needs answered.

Where probate does apply, working with an agent and attorney who handle these sales regularly prevents surprises that cost a deal later.

Sequence

What Usually Happens

  1. 1A petition for probate is filed and a hearing date is set
  2. 2The court appoints a personal representative and issues Letters
  3. 3Notice to creditors is given and a claim period runs
  4. 4The estate's assets, including real property, are inventoried and managed
  5. 5After debts are resolved and any required accounting is approved, remaining assets are distributed

What Tells Them Apart

Probate is the court process itself. An Estate is what that process administers, everything the person owned. Testate describes whether a valid will exists, which affects how probate proceeds but is a separate fact from probate itself. Ancillary Probate is a second, related proceeding needed when property sits in a different state from where the primary probate was opened.

Questions

Questions People Ask

Does every house have to go through probate in Nevada?

No. Property held in a trust, in joint tenancy with right of survivorship, or transferred through a properly executed transfer on death deed generally passes outside probate. Whether a specific property requires probate depends on exactly how title was held, which the recorded deed will show.

How long does probate typically take before a house can be sold?

It varies considerably depending on the county, whether the estate is contested, and whether the sale requires court confirmation. Simple, uncontested estates generally move faster than complex or disputed ones. An estate attorney can give a realistic estimate based on the specific circumstances rather than a general timeline.
