Who you are working with, and how representation begins

Nevada Estate Property Solutions is the estate property practice of Ryan Borden, a Nevada real estate broker with Realty ONE Group Eminence, an independently owned and operated office. We represent you only under a written agreement, and we disclose any personal interest in a transaction in writing.

This summary is written for clarity and is not a substitute for the notice itself.

Nevada Estate Property Solutions, or NEPS, is a marketing brand for estate related real estate services provided through Realty ONE Group Eminence. NEPS is not a separate law firm, accounting firm, appraisal company, fiduciary, or separate real estate brokerage.

Ryan Borden provides real estate brokerage services through Realty ONE Group Eminence in Northern Nevada. This disclosure explains the brokerage relationship, how representation begins, and several matters that may be important when evaluating real estate services or property information.

Licensing and Brokerage

Ryan Borden is a Nevada real estate broker. Realty ONE Group Eminence is the licensed brokerage through which the real estate services described on this website are provided.

Nevada real estate advertising rules require a licensee’s license number to appear conspicuously in advertising and require the licensed brokerage name to be identified. The Nevada Real Estate Division provides a public license lookup for verification of real estate credentials.

About NEPS

Nevada Estate Property Solutions is the marketing brand used on this website for estate related real estate services. The brand is used to describe services for probate, trust, inherited, and other estate property situations, but the underlying real estate brokerage is Realty ONE Group Eminence.

Submitting a website form, requesting educational information, or receiving a Property Options Review does not by itself create a brokerage relationship or obligate a person to list, sell, buy, or otherwise transact through Ryan Borden or Realty ONE Group Eminence.

Franchise Disclosure

Realty ONE Group Eminence operates as an independently owned and operated Realty ONE Group franchise. Nevada advertising rules require franchise advertising to identify the licensed brokerage name and acknowledge that each office is independently owned and operated.

How Representation Begins

A brokerage relationship begins through the applicable written brokerage agreement, not merely by visiting this website, submitting a form, requesting information, or having an initial conversation. The written agreement identifies the parties, the services to be provided, and the terms of the representation.

Nevada requires real estate licensees to provide the Duties Owed by a Nevada Real Estate Licensee disclosure to parties as required by law. That disclosure describes duties owed to parties and clients and does not itself create a contract for services.

If a licensee proposes to act for more than one party whose interests are adverse, Nevada law generally requires disclosure and written consent before the licensee continues in that role, subject to the rules for separately assigned licensees within the same brokerage.

Broker Compensation

Real estate brokerage compensation is established by agreement and is not set by Nevada law. The amount and structure of compensation should be stated in the applicable written agreement.

Nevada licensees are required to disclose each source from which they will receive compensation as a result of a transaction. Any compensation related to a specific transaction should be addressed in the transaction documents and required disclosures.

Personal Interest and Investor Options

The NEPS website may discuss cash offers or investor options as possible paths a property owner can evaluate alongside an open market sale. Those options should not be presented as automatically better or more appropriate than listing a property on the open market.

If Ryan Borden, Realty ONE Group Eminence, or an affiliated or related party is a principal to a transaction or has a financial interest in a principal, that interest should be disclosed in writing as required before an agreement is made. Property owners should be given a meaningful opportunity to compare alternatives and seek independent professional advice when appropriate.

Property Information

Property descriptions, public record information, measurements, photographs, condition information, estimates, and other property related materials may come from sellers, public records, vendors, multiple listing services, or other sources. Information believed to be reliable may still contain errors or may become outdated, and buyers should conduct their own inspections and verification.

Nevada uses a Seller’s Real Property Disclosure Form for residential property transactions subject to the applicable disclosure requirements. The disclosure is made by the seller, not by the seller’s real estate agent.

In estate or trust situations, a seller or fiduciary may have limited personal knowledge of the property’s history or condition. The extent of any disclosure obligation depends on the facts and applicable law, so questions about a seller’s legal obligations should be directed to an attorney or other appropriately qualified professional.

Verify a License

The Nevada Real Estate Division maintains a public license lookup that may be used to check the status and credentials of Nevada real estate professionals.

Equal Housing Opportunity

Realty ONE Group Eminence and NEPS support equal housing opportunity and provide real estate services without unlawful discrimination. Additional information about our fair housing practices is provided in the Fair Housing Statement.
