Estate Tax

es·tate tax

Also called Death Tax

Short Definition

A federal tax on the total value of an estate above a high exemption threshold, paid by the estate itself before distribution occurs. Most estates fall well under the threshold and owe nothing at all.

In a Sale

What This Means When the House Is Being Sold

Families often confuse this with the tax they personally might owe on selling an inherited house, which is a different tax entirely, usually much smaller, and calculated differently. Estate tax applies only above a federal exemption most households never approach, and where an estate does sit near or above it, real property is typically the largest asset that has to be valued for the calculation.

Where estate tax genuinely applies, a sale of real property can affect timing. Payment is often due within a set period after death regardless of whether assets have been converted to cash, which occasionally makes selling the house sooner, rather than later, a practical necessity rather than a choice.

What Tells Them Apart

Estate tax is paid by the estate on its total value, above a high federal threshold most estates never reach. Capital Gains Tax is paid on the gain from selling a specific asset. Estate Income Tax is on income the estate earns while it is open. Inheritance Tax, which Nevada does not impose, would be paid by beneficiaries on what they receive.

Nevada

In Nevada

Nevada imposes no state estate tax or inheritance tax, so exposure to this tax for a Nevada estate is a federal question only.

Questions

Questions People Ask

Do most estates owe estate tax?

No. Estate tax applies only above a federal exemption that is high enough that most estates fall well under it and owe nothing. Where an estate is close to or above the threshold, an estate attorney or tax advisor should be brought in early, since valuation and timing both matter.
