Capital Gains Tax

cap·i·tal gains tax

Also called Capital Gains

Short Definition

Tax on the gain when property is sold for more than its basis. For inherited property the basis is usually reset at the date of death, which often leaves far less gain than families expect.

In a Sale

What This Means When the House Is Being Sold

Fear of this tax delays more estate sales than almost anything else, and the fear is frequently misplaced. Where basis resets at the date of death, a property sold reasonably close to that date often shows a small gain or a small loss, not the gain measured from what a parent paid in 1978.

The irony is that waiting creates the problem. Gain runs from the date of death forward, so a house held for three years in a rising market accrues exactly the taxable gain the family was trying to avoid, alongside three years of taxes, insurance, and maintenance. A tax advisor should run the numbers before a hold decision, not after it.

What Tells Them Apart

Capital gains tax is paid by whoever sells, on the gain over basis. Estate tax is a different tax, assessed on the estate itself and applying only above a federal threshold that most estates never approach. Step-Up in Basis is the mechanism that usually reduces the capital gain on inherited property, and Cost Basis is the number it resets.

Nevada

In Nevada

Nevada has no state income tax, so a gain on a Nevada sale is generally a federal matter for a Nevada resident. Heirs living in another state may face tax where they live, which a tax advisor can address.

Questions

Questions People Ask

Do you pay capital gains on an inherited house?

Often less than expected, and sometimes nothing. Inherited property usually receives a basis reset to its value at the date of death, so the gain is measured from that date rather than from what the deceased originally paid. A tax advisor can confirm how it applies to a specific sale.

Does waiting to sell an inherited house reduce capital gains?

Usually the opposite. Gain accrues from the date of death onward, so a rising market during a long hold builds the taxable gain rather than reducing it, on top of carrying costs. Whether holding makes sense is a question for a tax advisor and turns on more than tax alone.
