Affidavit of Entitlement

af·fi·da·vit of en·ti·tle·ment

Also called Small Estate Affidavit, Affidavit of Small Estate

Short Definition

A sworn statement used in Nevada to collect a small estate’s assets without opening a full probate. It is signed by the person claiming entitlement and presented directly to whoever holds the asset, such as a bank.

In a Sale

What This Means When the House Is Being Sold

This is the procedure families hope applies, because it is quick and requires no court appointment. The question that decides whether it helps is whether it reaches real property at all, and whether the estate falls under the value limit.

Where it does not reach the house, the affidavit still has a use. It can free up a bank account so someone can pay the power bill, the insurance premium, and the lawn service while a fuller proceeding gets underway. Estate property left with no utilities and no maintenance deteriorates quickly, and a vacant house with a canceled policy is a much harder sale.

Title companies apply their own underwriting standards to affidavit based transfers, and those standards are not uniform. Confirming what a specific title company will accept beats discovering the answer at closing.

Sequence

What Usually Happens

  1. 1A waiting period after the date of death must pass
  2. 2The estate is reviewed against the small estate value limits
  3. 3The affidavit is completed, signed, and supported by a death certificate
  4. 4The affidavit is presented to the bank, company, or party holding the asset

What Tells Them Apart

All three are routes for smaller estates and they are not interchangeable. An affidavit of entitlement is presented to whoever holds the asset and generally involves no appointment at all. A set aside estate and a summary administration are both court proceedings, with different thresholds and different levels of court involvement. Which one an estate qualifies for depends on its value and what it holds.

This is a Nevada procedure with its own value limit and its own form. Estates holding real property often fall outside it.

Questions

Questions People Ask

Can you sell a house with an affidavit of entitlement in Nevada?

Often not. The procedure is aimed at collecting assets from institutions that hold them, and transferring real property usually requires a different route. A title company will say what it is willing to insure, and an estate attorney can confirm whether a specific property qualifies.

How long do you have to wait to use an affidavit of entitlement?

There is a waiting period after the date of death before the affidavit can be presented. The length is set by statute, and the party holding the asset will usually confirm what they require before they release anything.

What is the difference between an affidavit of entitlement and probate?

An affidavit is a sworn statement handed to whoever holds an asset, with no court appointment behind it. Probate is a court proceeding that appoints someone and supervises the estate. The affidavit is faster and cheaper where it applies, and it applies to a narrow set of estates.
